1. Agreement to Terms

By accessing lensshiftai.co (the "Site") or purchasing any program offered by McCain & Associates LLC, operating as LensShift AI™ ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site. These Terms apply to all visitors, users, and customers.

2. Description of Services

LensShift AI™ provides digital career strategy programs, assessments, and educational content designed to help professionals reposition their expertise in an AI-augmented economy. Our current program offerings include:

• LensShift™ AI Career Plan ($297) — A self-guided digital program delivering a personalized 60–90 day career repositioning action plan.
• LensShift™ 911 ($697) — An accelerated career strategy system for professionals in active transition, including enhanced frameworks and positioning tools.
• LensShift™ Elite ($1,997) — A high-touch execution and advancement system for professionals ready to accelerate income, visibility, and career trajectory using AI.

All programs are delivered digitally. No physical products will be shipped. Access to program materials is granted upon receipt of full payment.

3. Not Professional Advice

The content provided through LensShift AI™ programs, assessments, and the Site is for educational and informational purposes only. It does not constitute legal, financial, employment, or professional career advice. Results described in testimonials and case studies are illustrative and not guaranteed. Individual outcomes will vary based on personal effort, experience, market conditions, and other factors outside our control. We make no representations or warranties regarding specific career outcomes, income levels, or employment results.

4. Intellectual Property

All content on the Site and within our programs — including but not limited to text, graphics, frameworks, assessments, worksheets, videos, and the LensShift AI™ and LensShift™ brand marks — is the exclusive property of McCain & Associates LLC and is protected by applicable copyright, trademark, and intellectual property laws.

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and use program materials for your own personal, non-commercial career development purposes. You may not reproduce, distribute, resell, sublicense, publicly display, or create derivative works from any program content without our prior written consent.

5. Payment and Billing

All purchases are processed securely through Stripe, Inc. By completing a purchase, you authorize us to charge the stated program fee to your selected payment method. All prices are listed in U.S. dollars. We reserve the right to modify pricing at any time; however, price changes will not affect purchases already completed.

In the event of a payment dispute or chargeback filed without first contacting us to resolve the issue, we reserve the right to suspend or terminate your access to program materials pending resolution.

6. Prohibited Conduct

You agree not to:

• Share, resell, or distribute program access credentials or materials to any third party
• Use the Site or programs for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, copy, or replicate our proprietary frameworks or assessment methodology
• Post false, misleading, or defamatory content about the Company or its programs
• Interfere with or disrupt the security or integrity of the Site

7. Disclaimer of Warranties

THE SITE AND ALL PROGRAMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCCAIN & ASSOCIATES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PROGRAMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PROGRAM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which McCain & Associates LLC is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in that state.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top of this page when changes are made.
